Live-in Relationship is a Foreign Concept not acceptable in India - High Court

The Allahabad High Court has ordered a Muslim girl to be sent to Nari Niketan in Lucknow. This decision was taken even though the girl requested to stay with her Hindu live-in partner or husband. The court’s ruling was influenced by uncertainties about the girl’s exact age and her mother’s claims. Allahabad HC Declares Live-in Relationship is a Foreign Concept not acceptable in India.

The girl’s mother filed a habeas corpus petition. She alleged that her daughter was kidnapped by the Hindu man and held in his illegal custody. The mother claimed she tried to file a case against the man and submitted an application to the Lucknow Police Commissioner on July 15 but no action was taken. The Live in relationship not acceptable in India after this incident.

Court’s Response and Police Action

During the hearing the Police Commissioner appeared with the Station House Officer (SHO) concerned. The Commissioner apologized for the SHO’s negligence. He assured the court that he would personally monitor such cases and instruct all SHOs in Lucknow to be more vigilant. The SHO of Jankipuram police station reported that he had tried to mediate between the parties. 

He found that the Muslim girl and the Hindu man were in a relationship and claimed to be married. However, the validity of their marriage agreement was unverified. He did not allow the girl to go with her partner due to the uncertainty of her age.

The girl’s mother contended in court that the marriage agreement which was dated January 16, 2024, listed her daughter’s birth date as January 1, 2000. She argued this was impossible since her own marriage took place in 2002. She accused the Hindu man of forging her daughter’s date of birth. The court ordered a radiological examination to determine the girl’s age.

Court’s Decision ‘Live-in Relationship is not acceptable in India’

Justice Shamim Ahmed concluded that it was improper to send the girl with the man. The court noted that the girl and the man were not legally married and there was no evidence validating their marriage agreement. The judge emphasized that such relationships are not accepted by society. 

He stated, “We do not live in a Western country where this type of relationship is popular and common among citizens. We live in a country where people believe in culture and traditions, which are the crown of our country and which we are proud of. Therefore, we must respect the traditions and culture of our country.” Therefore the Live in relationship not acceptable in India.

The court directed the SHO of Jankipuram police station to take appropriate action against the Hindu man for forging documents. The case will be heard again on August 16. The Superintendent of Nari Niketan has been ordered to present the girl in person at the next hearing.
