Supreme Court Affirms High-Scoring Reserved Candidates Get Open Seats

The Supreme Court clarified that candidates from reserved categories who exceed the general category cutoff placed in unreserved seats.

Supreme Court confirm open seats for reserved category candidates

In their judgment, Justices M MSundresh and Satish Chandra Sharma confirmed that reserved candidates (SC, ST, OBC) who score above the general cutoff marks qualify for open positions. This ruling supports the merit principle outlined in Articles 14 and 16.

The Court overturned a Kerala High Court decision that favored reserved quotas. This ruling acknowledged shifts based on merit and keeps reserved seats available for other candidates. The issue arise from AAI’s 2013 recruitment process that challenged by Sham Krishna B, an unreserved candidate.
