The Delhi High Court suspended the sentence of expelled BJP leader Kuldeep Singh Sengar. He is serving life in Jail for the Unnao rape case. He was granted bail with strict conditions to ensure the safety of the survivor and her mother.
The suspension will stay in effect while Sengar’s appeal is pending. He is appealing against his conviction and life sentence given by a trial court in December 2019. The trial court found him guilty of kidnapping and raping a minor girl in 2017. During his time in Jail, he received bail multiple times, reportedly for eye surgery and other health issues.
Delhi High Court Suspends Sengar’s Rape Sentence
A bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar ordered Sengar’s release on a personal bond of Rs 15 lakh with three sureties of the same amount.
The court set strict conditions, instructing him not to enter a five-kilometer radius of the survivor’s home and not to threaten or contact her or her mother. The court warned that any violation of these conditions would result in the cancellation of bail.
Sengar challenge conviction
Following directions from the Supreme Court, the trial and related cases moved from Uttar Pradesh to Delhi in August 2019. The survivor’s father died in police custody. The family and lawyers filed another case related to his custodial death. Sengar also convicted in this case by the trial court and sentenced to ten years in Jail.
Sengar has challenged this conviction as well in the high court, and his appeal is pending in this case related to the custodial death of the survivor’s father. The Delhi High Court granted his bail plea for suspension of sentence, stating that he has already served a significant part of his sentence and both of his appeals are still pending.
