He said that fathers must get the paternity leave to focus on their child caregiving rather than job after birth. Mothers need their partner’s support during recovery. He framed this issue as both a public concern and a personal matter.

India currently does not have a law that guarantees paternity leave in the private sector, which leaves most fathers at the mercy of company policies. Government employees get 15 days of paid leave under the Central Civil Services rules. However, past attempts to pass legislation, such as the 2017 Paternity Benefit Bill, have failed. In contrast, countries like Sweden, Norway, and Japan provide extensive, legally protected leave for fathers, with durations ranges from 90 days to over a year.
Raghav Chadha effort aligns with recent Supreme Court comments that stress the importance of a father’s role in a child’s development. The court pointed out that parenting is a shared obligation and that fathers should have chances to be involved in early childcare.
