Bombay High Court Instructs BMC to halt demolition of the Jain temple Mumbai

The Bombay High Court on April 16 directed the Brihanmumbai Municipal Corporation (BMC) to right away halt a similar demolition of the Jain temple structure placed in Mumbai’s Vile Parle.  Justice Gauri Godse passed the order after Shree 1008 Digambar Jain Mandir Trust filed two appeals through the demolition action initiated by the civic body. The Court granted ad-meantime safety to the temple premises until the following hearing on April 30.

Bombay High Court halts Jain Temple demolition

The dispute stemmed from demolition action initiated by BMC based on an observation issued under Section 53(1) of the Maharashtra Regional and Town Planning Act (MRTP Act) and some others under Section 488 of the Mumbai Municipal Corporation (MMC) Act. In ongoing civil body related to the problem, the metropolis civil court room dismissed interim safety applications on April 7.

However, it had extended a previous life for 7 days, which expired on April 15. On that date, the Trust sought an extension, but as per the appellants, the city civil court room orally rejected the request. Since the reasoned order of rejection was not available, the Trust approached the High Court on April 16.

Taking focus of the urgency—especially because that BMC officials had arrived on the site with police to perform the demolition—Justice Godse permitted the problem to be heard at 11 am. During the hearing to, Senior Advocate Surel Shah, performing for the Trust, knowledgeable the Bombay High Court that only a part of the outer shape has been demolished and the main structure stood.

BMC recommended Drupad Patil, after taking instructions from Assistant Engineer (B&F) Satish Anerao, knowledgeable the Court that barring walls measuring 15 feet and 7 feet in duration (every 10 feet high), the relaxation of the temple shape has already been razed.
