Supreme Court objection on Allahabad High Court observation for granting Bail to Accused in Rape Case

The Supreme Court on Tuesday objects judges against making beside the point observations in cases related to sexual violence towards women. A Bench of Justices BR Gavai and Augustine George Masih took place to a latest observation by the Allahabad High Court that the woman herself had invited trouble and was responsible for the alleged rape devoted towards her.

Justice Sanjay Kumar Singh of the High Court had made this touch upon March 11 while as granting bail to an accused who become arrested in December 2024 for alleged rape of a women he had met at a bar in Hauz Khas, Delhi.

Supreme Court Objects on Giving Bail to Rape Accused

The Supreme Court today stated that even as grant of bail is the discretion of the decide relying on the records of each case, such unwarranted observations against the complainant have to be prevented.

Court Looking for Responses from Central Authorities

The Supreme Court had raise the problem suo motu after the judgment was delivered to the awareness of Court through an group ‘We the Women of India’. The court room had on March 26 stayed the High Court order after finding that the order meditated lack of sensitivity at the part of the High Court decide who passed the same and it was not a spur of the moment order.

It had also sought responses from the Central authorities and the Uttar Pradesh (UP) authorities on the matter and also sought the assistance of Attorney General (AG) R Venkataramani and SG Tushar Mehta.
