The US hit Indians by announced a new rule to stop the automatic extension of Employment Authorization Documents (EAD) for migrant workers. It will impact thousands of foreign employees, including many Indians who make up a large part of the expat workforce.
In a statement on Wednesday, the Department said, “Aliens who file to renew their EAD on or after Oct. 30, 2025, will not receive an automatic extension of their EAD.” This means that EADs automatically extended before October 30 will remain unaffected.

With this new rule, there will be more vetting and screening to protect public safety and national security, according to the Trump administration. This rule replaces the Biden administration’s practice, which allowed immigrants to work in the US for 540 days after their work permit expired if
- The renewal application filed on time
- Their EAD category qualified for an automatic extension
- The category on their current EAD matched the “Eligibility Category” or “Class Requested” on the receipt notice.
The statement from the US Department of Homeland Security noted, “There are limited exceptions to this rule, including extensions provided by law or through a Federal Register notice for TPS-related employment documentation.”
Who Needs EAD?
An EAD (Form I-766/EAD) serves as proof that an individual is authorized to work in the US for a specific period. Permanent residents do not need to apply for an EAD. A Green Card (Form I-551, Permanent Resident Card) acts as evidence of employment authorization. Individuals with non-immigrant status (like H-1B, L-1B, O, or P visas) also do not need this document.
