Gulfisha Fatima walked out of Tihar on Wednesday. She embraced by her family and surrounded by cameras. Her emotions were clear after years in custody. She was one of the accused in the 2020 northeast Delhi riots conspiracy case. Hours after a Delhi court issued the orders following Supreme Court bail, she was released.
Gulfisha Fatima release from Jail after 6 years
Earlier in the day, Additional Sessions Judge Sameer Bajpai of Karkardooma Courts issued release orders for Gulfisha, MeeranHaider, Shifa Ur Rehman, and MohdSaleem Khan. The judge accepted their bail bonds of Rs 2 lakh each and issued their release orders. This followed the Delhi Police submitting verification reports about the documents and sureties provided by the accused. The fifth accused, Shadab Ahmed, also granted bail by the Supreme Court on Monday, did not appear before the court to provide bail bonds.
The court noted that all bail conditions met and passed the orders for their release after the Delhi Police submitted verification reports of the sureties and documents.
Restrictions Clause
“The claim that Gulfisha Fatima mobilized local women and coordinated logistics at protest sites, while relevant to the prosecution’s case, does not show that she had independent command, resource control, or strategic oversight over multiple protest sites.”
“The prosecution itself states that directions given to her by others higher in the asserted hierarchy. In these circumstances, this court finds that the level of attributed agency and control not justify continued detention once the investigative purpose mostly fulfilled,” the bench said.
