In his request for Justice Swarana Kanta Sharma of the Delhi High Court to step aside from the liquor policy case, AAP leader Arvind Kejriwal has submitted an additional affidavit. He claims that Justice Sharma’s son and daughter both work as Central Government Counsel.
Kejriwal Files Affidavit to get justice in Excise Case
Kejriwal said that the Solicitor General of India, who represented the CBI before Justice Sharma, assigns tasks to Justice Sharma’s children. He believes this creates a reasonable fear of bias from Justice Sharma, which necessitates her recusal from considering the CBI’s plea against the discharge in the liquor policy case.
It is important to remember that on April 13, Justice Sharma had reserved her decision on the requests made by Kejriwal and other defendants, asking her to recuse herself from the revision petition filed by the CBI, which challenges the discharge of all defendants in the liquor policy case.
What affidavit includes?
After the hearing, Kejriwal submitted the current affidavit, said that he obtained records showing Justice Sharma’s children are Central Government Counsel. Her son serves as a Group A panel counsel for the Supreme Court, while her daughter is a Group C panel counsel. He pointed to information shared by legal reporter Saurav Das.
He also referred to a response on the Ministry of Law & Justice website, which said, “While in the Supreme Court, the Attorney General for India selects cases for his own appearance, while other cases are assigned by the Solicitor General for India to Additional Solicitors General for India and Panel Counsel.”
