Elon Musk accuses Microsoft of illegally using Twitter data in letter to Satya Nadella

Earlier this month, Elon Musk’s lawyer sent Microsoft Chairman and CEO Satya Nadella a letter accusing the tech giant of repeatedly violating Twitter’s developer agreement.

With Xbox, Bing search and its ads platform, Microsoft integrated eight separate Twitter APIs.

The company agreed to comply with Twitter’s Developer Agreement and Policy by registering and using these eight Twitter API apps (collectively, the Microsoft Apps).

In 2022 alone, Microsoft Apps accessed Twitter’s APIs over 780 million times and retrieved over 26 billion tweets.

For one of the Microsoft Apps, Microsoft’s account information states that it intends to allow customers to circumvent throttling limits.

Earlier this month, Twitter’s outgoing CEO threatened to sue Microsoft for illegally using Twitter data for training.

As a result of Microsoft’s refusal to pay Twitter’s application programming interface (API) fees, Musk dropped Twitter from its advertising platform.

A tweet from Musk said, “They trained illegally using Twitter data. Lawsuit time.

Spiro’s letter to Nadella, however, does not mention legal action.

A Microsoft spokesperson told The Verge that they were contacted by a law firm representing Twitter with questions about our use of the free Twitter API in the past.

According to the spokesperson, we will review these questions and respond appropriately. We look forward to continuing our long-term partnership with the company.

According to the Spiro letter, Microsoft must cooperate fully and assist with the compliance audit requested under the Agreement.

Please provide a date certain by which Microsoft will provide the requested information, and, in any event, no later than June 7, 2023.
